1. Acceptance of Terms

By accessing or using Bubble Calm, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. Description of Service

Bubble Calm is a mobile application designed to provide a calming, meditative experience through interactive bubble-popping gameplay. The App offers:

• Free features including basic bubble interactions and gameplay
• Premium features ("Bubble Calm Plus") available through in-app purchase, including:
  • Customizable bubble colors and visual styles
  • Enhanced pop effects
  • Background customization (solid colors, gradients, patterns)
  • Ambient soundscapes
  • Breathing overlay guides
  • Advanced settings and presets

3. Eligibility

You must be at least 13 years of age to use Bubble Calm. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

4. In-App Purchases and Subscriptions

4.1 Premium Features

Bubble Calm Plus is available as an in-app purchase subscription. When you purchase Bubble Calm Plus, you gain access to premium features for the duration of your subscription.

4.2 Payment and Billing

• All purchases are processed through the Apple App Store
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Apple ID Account Settings after purchase

4.3 Refunds

Refund requests must be submitted to Apple through the App Store's standard refund process. We do not process refunds directly. Apple's refund policy applies to all purchases.

4.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods.

5. User Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove, alter, or obscure any proprietary notices or labels
• Interfere with or disrupt the App or servers connected to the App
• Use the App in any way that could damage, disable, or impair our services

6. Intellectual Property

All content, features, and functionality of Bubble Calm, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of picturing bits or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Privacy

Your use of Bubble Calm is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.

8. Disclaimers and Limitation of Liability

8.1 No Medical or Professional Advice

Bubble Calm is designed for entertainment and relaxation purposes only. The App is not intended to diagnose, treat, cure, or prevent any medical condition. It is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified health providers with any questions you may have regarding a medical condition.

8.2 Service Availability

We strive to provide a reliable service but do not guarantee that the App will be available at all times or free from errors, bugs, or interruptions. We reserve the right to modify, suspend, or discontinue any aspect of the App at any time.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PICTURING BITS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

9. Indemnification

You agree to indemnify, defend, and hold harmless picturing bits, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App or violation of these Terms.

10. Termination

We reserve the right to terminate or suspend your access to the App immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the App will cease immediately.

You may stop using the App at any time by uninstalling it from your device.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last Updated" date at the top of this document. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Paris, France.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and picturing bits regarding your use of Bubble Calm and supersede all prior agreements and understandings.
